If we are to follow Perak and Penang style, there should be two. Maybe the government may amend the constitution later. For the moment, the Deputy MB post will be allocated later, says new MB Khalid Ibrahim. He said Manoharan can be sworn in later since he is not part of the EXCO.<\/p>\n<blockquote><p><strong><span style=\"color: #ff0000\">There is no urgency because he is not being made an executive councillor\u00a0<\/span><\/strong><\/p><\/blockquote>\n<p>Since Selangor also has 10 EXCO positions, how would it turn out?<\/p>\n<p>MB: PKR<\/p>\n<p>DMB: DAP \/ PAS<\/p>\n<p>EXCO: PKR 4, DAP 4, PAS 2 (if DMB is DAP) or PKR 4, DAP 5, PAS 1 (if DMB is PAS)<\/p>\n<p>Possible?<\/p>\n<p>Meanwhile, the buck is being passed around on who actually wants a Malay deputy. The Private Secretary says it is &#8220;preferable&#8221; since Sultan is in charge of Islamic affairs, and the MB needs to assist the Sultan. The MB needs to be assisted by the Deputy, so he must be Muslim as well. In other words, they want it, but don&#8217;t want to say it directly. Anyway, I doubt the secretary will speak without approval from our Sultan.<\/p>\n<p>Now, lets say by act of God, all three are not around. So, next will be an EXCO or the the Mufti who will take over and assist in Islamic affairs. Its like A cant, so pass to B. If B can&#8217;t, pass to C. Then if we are to extend this: if C can&#8217;t, pass to D. if D can&#8217;t, pass to E&#8230;and so on until we run out of alphabets. To cut the story short, why not make it clear that the whole EXCO be Malay Muslims to ensure there&#8217;s a backup to assist another backup who will assist another backup who will&#8230;you get the point! I&#8217;m sure the rakyat will understand this kind of logic. No problem. Then, we can move forward.<\/p>\n<p><strong>Expert: No legal need for Malay deputy MB<\/strong><\/p>\n<p>http:\/\/www.malaysiakini.com\/news\/79805<br \/>\nK Kabilan | Mar 14, 08 10:53am<\/p>\n<p>A constitutional expert today dismissed claims being made by the Selangor royal household that the deputy menteri besar should ideally be a Malay to assist the menteri besar in Islamic and cultural duties. &#8220;<strong><span style=\"color: #ff0000\">The Sultan of Selangor does not need the menteri besar or the deputy menteri besar in matters pertaining to religion and Malay custom<\/span><\/strong>,&#8221; Prof Abdul Aziz Bari (left), who lectures law at the International Islamic University Malaysia, told Malaysiakini. He added that the <strong><span style=\"color: #ff0000\">sultan, being the head of Islamic matters and the Malay adat, is the person in charge of such matters in the state, and not the menteri besar or his deputy<\/span><\/strong>.<\/p>\n<p>Abdul Aziz was referring to media statements made by the Selangor sultan&#8217;s private secretary Muhammad Munir Bani on the palace&#8217;s &#8220;preference&#8221; for a Malay deputy menteri besar. Yesterday Muhammad Munir denied reports that the sultan wanted &#8220;a deputy from a particular race&#8221;. However, he added the sultan was the religious head for Islam and Malay culture and the mentri besar has the task of assisting in these duties, which would also have to handled by his deputy and as such, it was only proper that a Malay be the deputy mentri besar.<\/p>\n<p>PKR&#8217;s secretary-general and Ijok state assemblyperson Khalid Ibrahim (photo, right) was sworn in as the new menteri besar yesterday. Khalid has not named his deputy but it is believed that a Chinese candidate from the DAP, which is second biggest party in the ruling coalition, will fill in that slot.<\/p>\n<p><strong>Unnecessary and unconstitutional<\/strong><\/p>\n<p>Abdul Aziz said that a prolonged delay in the appointment of a deputy menteri besar was unnecessary and might even be unconstitutional.\u00a0 Matters cited by the palace are entirely within the sultan&#8217;s jurisdiction,&#8221; he said. Abdul Aziz added that this was also the position in eight other states which has sultan or raja. In states without the sultans &#8211; Malacca, Penang, Sabah and Sarawak &#8211; the gap is filled by the Yang di Pertuan Agong.<br \/>\n&#8220;As the sultan may act on his own discretion on these matters, the constitution provides that a council may be appointed to assist him. &#8220;This is <strong><span style=\"color: #ff0000\">what is commonly known as religious councils or majlis agama, which looks after the religious department or the jabatan agama<\/span><\/strong>. In the other four states and federal territories, the Agong will have the same establishment,&#8221; added Abdul Aziz.<\/p>\n<p>He further stated that in any event that the sultan needs assistance on such matters, he has the state mufti to fall back on.<\/p>\n<p>&#8220;The reason why the constitution put those matters under the sultan&#8217;s exclusive jurisdiction is pretty clear; namely history and that it will prevent religion from being politicised. &#8220;Given this, <strong><span style=\"color: #ff0000\">the reading of the Selangor palace is quite contrary to the spirit of the constitution<\/span><\/strong>. &#8220;In fact, the problem within the Muslim community is that the politicians control the mosques while religious matters are being handled politically at the expense of Islam,&#8221; he said.<\/p>\n<p><strong>Khir&#8217;s problem<\/strong><\/p>\n<p>Abdul Aziz said the Selangor palace must differentiate state religious matters and state administration, adding that the state constitution does not allow for these to be mixed. He added it was precisely this convergence that caused the Barisan Nasional to suffer defeats in Saturday&#8217;s national polls. &#8220;One of the reasons why PAS thrived was (former menteri besar Dr Mohd) Khir Toyo (right) behaved as if he was the head of Islam. &#8220;This makes <strong><span style=\"color: #ff0000\">one wonders where the sultan is for he is the head of religion with an essentially absolute power to look after the religion<\/span><\/strong>,&#8221; added Abdul Aziz.<\/p>\n<p>He also noted that <strong><span style=\"color: #ff0000\">his comments on this matter were not seditious as the &#8220;law says one may point out mistakes&#8221;<\/span><\/strong>. &#8220;And it is important that the<strong><span style=\"color: #ff0000\"> better interpretation of the constitution is put in the public domain<\/span><\/strong>,&#8221; he added.<\/p>\n<p>Khalid told the media yesterday that he has not decided on his deputy, whom he said could be from any race. Manoharan, who won a Selangor state seat, to be sworn in. &#8220;There is no urgency because he is not being made an executive councillor, so the oath taking can wait until after he is released. For now, there is nothing we can do, his detention is a political issue,&#8221; Selangor Mentri Besar Tan Sri Khalid Ibrahim said. Manoharan, under detention at the Kamunting Detention Camp for his involvement in the Hindu Rights Action Force, won the Kota Alam Shah seat with a 7,184-vote majority. Khalid said the Opposition will call for the repeal of the ISA in Parliament.<\/p>\n<p><strong>No Deputy MB yet for Selangor<\/strong><\/p>\n<p><a href=\"http:\/\/thestar.com.my\/election\/story.asp?file=\/2008\/3\/14\/election2008\/20643734&amp;sec=Election2008\" target=\"_blank\">source<\/a><\/p>\n<p>SHAH ALAM: <span style=\"color: #ff0000\">Selangor will not have a Deputy Mentri Besar for now to prevent friction among the three parties forming the state government<\/span>. Parti Keadilan Rakyat (PKR) secretary-general Tan Sri Khalid Ibrahim said putting the decision off for now would ease tension within PKR, DAP and PAS as he had come under a lot of pressure from those who wanted the post. He also said there was no deadline set by the Sultan of Selangor Sultan Sharafuddin Idris Shah for naming the deputy.<\/p>\n<p>It has been widely speculated that DAP would land the seat as it has 13 of the 36 seats won by the Opposition. PKR has 15 and PAS only eight but it was rumoured that DAP might not be considered as the palace preferred a Malay to hold the position.<\/p>\n<p><span style=\"color: #ff0000\">The Selangor Sultan&#8217;s private secretary Datuk Lela Bakti Datuk Muhammad Munir Bani said since the Sultan had not yet been advised by the Mentri Besar on the candidate for the deputy&#8217;s post, the matter of a Malay being preferred did not arise.<\/span><\/p>\n<p>&#8220;There have been reports claiming the Sultan wants a deputy from a particular race but this not true, so I advise these parties to stop spreading news that put the palace in the wrong light,&#8221; he said.<\/p>\n<p>However, <span style=\"color: #ff0000\">he said, the Sultan was the religious head for Islam and Malay culture and the Mentri Besar has the task of assisting in these duties, which would also have to handled by his deputy and as such, it was only proper that a Malay be the Deputy Mentri Besar<\/span>. [does this mean the private secretary is talking on behalf of the Sultan or for himself? the previous paragraph contradicts this paragraph]<\/p>\n<p>Khalid said the duties of a Deputy Mentri Besar were only to assist the Mentri Besar in carrying out his duties, functions and responsibilities and the government would have four years or more to decide on the deputy, so there was no need to rush into the matter.<\/p>\n<p>&#8220;The issue of appointing a Deputy Mentri Besar is a mere technical issue that we need to take time to resolve, but we must function as a government quickly to sustain the development of the state and look at its future,&#8221; he told a press conference after being sworn in as the14th Mentri Besar at the Bukit Kayangan palace.<\/p>\n<p>He said his focus now was on completing the list for the line-up for the state executive council as this was necessary for the PKR, DAP and PAS to start functioning as a government. Khalid said Sultan Sharafuddin had told him to start working on the list of state executive councillors and had given him until March 22 to complete the list and hold the swearing-in ceremony for them.
