Perak turned into playground

Perak’s situation is getting worse. I suspect one of two things tomorrow – court ruling in favor of UMNO or ISA being used against the PR EXCOs, especially Sivakumar, Ngeh, and Nizar. Zambry already mentioned the magic words – “threat to national security”. Indeed, Malaysiakini article outlines few possible scenarios:

Scenario 1

As it stands now, the most likely scenario would be for Sivakumar to conduct his meeting as planned and get the motions passed and then submit them to the Sultan of Perak for further action.

It is still uncertain though if the sultan will accede to the wishes of the Pakatan representatives and agree to dissolve the state assembly. The sultan has made his views clear on this matter by appointing Zambry as the new menteri besar on Feb 6.

Scenario 2

Perak BN, or the new menteri besar, can go to court and get an injunction against the emergency meeting. This is very likely to happen later today.

However, it has been a convention for our courts not to interfere in the functioning of the state assemblies.

“The courts tend to uphold the principles of separations of power in that they are on par with the legislative and executive,” noted constitutional expert Prof Aziz Bari.

Still, in the current political climate, it would be unwise to discount the possibility of judicial activism.

If such an injunction is granted, it would automatically mean that the emergency sitting of the state assembly tomorrow cannot proceed.

The Pakatan government or the speaker can try to revoke the injunction by appealing against it in court, triggering a long drawn out legal process.

It must be noted the Kuala Lumpur High Court is also set to hear tomorrow an application by Nizar on the legality of Zambry’s appointment as the menteri besar.

Scenario 3

Another legal aspect which Zambry can contemplate is to seek a court order to allow him, his exco members as well as the three BN-friendly independents to attend the meeting tomorrow.

In such a situation, the two motions can be defeated by BN, with the help of the three defectors.

The downside to this is that the speaker can appeal for a court ruling stating that he is the final authority on matters of state assembly.

Apart from his suspension of Zambry and the six exco members, the speaker can also point out that the status of the three independent representatives were questionable as he has received their resignation letters and had declared their seats as vacant.

This situation will also cause a legal imbroglio with no swift solution in sight.

Scenario 4

The Perak BN, which is the ruling party as per the sultan’s appointment, can order all civil servants and legislative assembly staff not to cooperate with Sivakumar and the Pakatan faction.

Doors to the assembly can then be kept shut and assembly officers may refuse to perform their duties. [Update – at 4pm, a state government circular was issued stating that the complex where the state assembly is located will be closed tomorrow].

If such a scenario arises, the speaker has the powers to declare another place as the venue for the emergency sitting and conduct the meeting there.

Even Nizar’s new official residence can be converted to function as a state assembly.

Scenario 5

The best the BN can then do to stop the meeting – and this is the least likely thing to happen – is to seek the dissolution of the state assembly, paving way for a snap state election.

The BN was against this option at the outset of the crisis, perhaps fearing that it would not be able to win.

Federal measures to ponder

Apart from the scenarios above, there are two other measures which can be taken by the federal government to save its rule in Perak.

However it must be said that both these measures would be highly unpopular, especially with BN facing three by-elections next month, with one in Perak.

Incoming Prime Minister Najib Abdul Razak, who is also the BN and Perak Umno chief, will have to be down to his last chips if he agrees to these two measures.

And what are they?

  • First, the BN government can instruct the police to arrest Perak Pakatan leaders under the Internal Security Act in the next 24 hours, thus making it impossible for the emergency meeting to take place. High on the list of potential detainees would be Sivakumar, Nizar and his exco members.

  • Secondly, the federal government can declare emergency in Perak to invoke direct federal rule in the state. In such cases, the state will be placed under the National Operations Council. This is not a new phenomenon as the BN federal government had done it previously in Kelantan in 1977, in a situation very similar to Perak today where an incumbent menteri besar refused to leave office.

These two scenarios are not totally ludicrous and has been mentioned by the Pakatan leaders as well, the most recent being PAS vice-president Husam Musa.

The next 48 hours look set to be an important phase in the Perak political landscape.

By the end of tomorrow, the constitutional crisis roiling the state could either be clearer or the events can take another nasty turn for the worse.

Note: the order to close State building’s front entrance was removed yesterday evening, but its  status and effect is unknown.

However, I also wonder if the state secretariat can take unilateral decision to close the main entrance and can the police stop assemblymen from entering the assembly hall. The unsigned notice says the main entrance will be closed, but its still a working day. Technically, assemblymen can enter the secretariat. So, will police arrest any PR assemblyman who tries to enter the premises? Was the Sultan consulted on this move?

Sivakumar, possibly the most famous man in the country now, faces new legal suits lodged by UMNO’s legal team. The cases will be heard tomorrow at the earliest.

It is bleak for PR. The state secretary, the police, and the courts may all favor against them. They may even join Uthaya in Kamunting if federal government decides to step in directly.

Time to rest. It will be a treacherous day tomorrow.

Veerasingam appointed as Perak EXCO

We are also asking for a representative that is the level of an executive councillor be appointed so that any issues raised by the Indian community can be brought directly to the attention of the exco.

It is only right to make such a request as the Indian community in Perak is the second-highest in the country after Selangor.

MIC got part of the wish today. S Veerasingam, one of the vice president of MIC, was appointed as special advisor to the MB with EXCO status. The list so far (with portfolios) is below:

The Perak State Committee Chairmen portfolios:

  • Datuk Dr Zambry Abdul Kadir who is also the Menteri Besar heads the Committee for Planning, Economy, Finance, Security, Land and Natural Resources, Agriculture, Housing and Religion.
  • Hamidah Osman : Industry, Investment, Entrepreneur Development, ICT, Tourism and Women’s Affairs
  • Datuk Ramly Zahari: Infrastructure, Public Facilities, Energy and Water.
  • Dr Mah Hang Soon: Health, Local Government, Consumer, Environment, Transport and Non-Muslim Affairs.
  • Datuk Saarani Mohamad: Information, Rural Development, Poverty, Welfare and Farming.
  • Mohd Zahir Abdul Khalid: Education, Higher Education, Science and Technology
  • Zainol Fadzi Paharuddin: Culture, Youth and Sports.
  • Advisers to Menteri Besar:

  • Datuk Mohd Najumuddin Elias – Adviser for Islamic Affairs.
  • Datuk Chang Ko Youn – Adviser for Chinese Affairs.
  • Datuk S. Veerasingam – Adviser for Indian Affairs.
  • Datuk Hamdi Abu Bakar – state Information chief.

The four vacant EXCO seats are still not filled and will be done so when the need arises, say BN Perak MB, Dr Zambry.

Surprisingly, Veerasingam gets a temporary lease of life. Not sure if it will give him some boost in the upcoming MIC elections.

Gerakan is also another surprise entry.

PPP did not get any representatives this time.

MIC eyes speaker post

NST reports Samy Vellu as saying 3 candidates being recommended for the post of assembly speaker, while Perak MIC chief Rajoo also said the party will ask new MB to appoint Indians as special officers:

The MIC wants the post of speaker of the Perak assembly.

Sources said party president Datuk Seri S. Samy Vellu had recommended three candidates to Deputy Prime Minister Datuk Seri Najib Razak.

It is understood that the candidates were a mixture of experienced faces and new blood.

Samy Vellu said the party had “made a representation to the deputy prime minister”.

“We have indicated what we need and we leave it to him to decide.

Perak has the largest number of Indians after Selangor and Kuala Lumpur and if we don’t plan things properly, it will be difficult to regain their votes in the next general election.”

In Perak, state MIC chief Datuk G. Rajoo said the party would ask Menteri Besar Datuk Dr Zambry Abdul Kadir to appoint Indian special officers to serve the interests of the community.

He said this was necessary as the state MIC did not have elected representatives in the state assembly.

All four MIC candidates who contested in the state constituencies of Behrang, Hutan Melintang, Pasir Panjang and Sungkai lost in the March 8 general election.

“There is a large Indian community in Perak but we do not have elected representatives in Barisan Nasional.

“We hope Zambry will consider this vacuum and appoint MIC leaders as special officers in charge of Indian affairs.”

According to Malaysiakini, the likely candidate for speaker is a “young Ipoh-based lawyer”. Besides that, both MIC and PPP are eyeing the position of special officer in the EXCO line-up.

The identity of this special officer is not known yet but it is believed that both MIC and Perak-based PPP are vying for their nominee to be appointed to this powerful post.

At the same time, community leaders have also expressed hope that such a post is filled by a non-political person.

Today, 6 of the 10 EXCO have been revealed:

1. Perak MCA Youth head Dr Mah Hang Soon (Chenderiang assemblyperson) – NEW

2. Perak Umno Youth head Zainol Padzi Paharudin (Sungai Manik) – NEW

3. Hamidah Osman (Sungai Rapat) – NEW (remember the “Indians and snakes” issues?)

4. Mohd Zahir Abdul Khalid (Kamunting) – NEW

5. Ramly Zahari (Manong) – was EXCO under previous BN govt

6. Saarani Mohamad (Kota Tampan) – was EXCO under previous BN govt

So far, its 5 UMNO and 1 MCA, which means that another four posts may go to the three defectors and one Indian special officer.

30k for Chinese school orchestra and 1ook for Hindu temple

New BN MB Dr Zambry acts fast indeed. He first announced RM30k for Yuk Choy Primary School orchestra, to which the crowd gave a rousing applause says Malaysiakini.

He also visited Arulmigusubramaniam Temple in Gunung Cheroh at 8.30am on Thaipusam day and during a short speech to the temple-goers, pledged RM100,000 for the temple.

That’s 13ok in 24 hours. Looks like the Chinese and Indians can look forward for more short-term goodies!

Umno Youth deputy chief Khairy Jamaluddin has called on party members to “resort to whatever means necessary” to prevent former menteri besar Datuk Seri Mohammad Nizar Jamaluddin and his group of executive councillors from entering the Perak state secretariat.

“I urge Umno Youth members to gather outside the gates and do what is necessary to stop the illegitimate menteri besar from entering the building,” he told some 1,000 BN supporters who gathered at a football field near the Ipoh City Council here yesterday to express their support for Sultan Perak Sultan Azlan Shah.

Speaking to reporters later, he denied Perak was experiencing a constitutional crisis, saying that the matter was a “crisis of power”.

“Why can’t Pakatan Rakyat accept the due process of law and admit defeat? When we lost five states in the March 8 polls, we backed out with maturity and magnanimity… It is evident from PR’s denial that they were never a coalition for the people but an alliance based on greed. They fell for Datuk Seri Anwar Ibrahim’s defection theory and it all backfired,” he said.
