The Kuala Lumpur High Court today ruled that entertainment outlet manager Ngiam Tee Kong had the right to claim his wife’s body following a three-week long dispute over the deceased’s religion.

According to his lawyer Karpal Singh, Justice Lau Bee Lan ordered Wong Sau Lan’s remains, which has been at the Hospital Universiti Kebangsaan Malaysia mortuary since she died, to be released to Ngiam.

The decision followed the Federal Territory Islamic Council’s admission that Wong’s conversion to Islam from Christianity was not done in accordance with the hukum syarak (Islamic law) and provisions in the Administration of Islamic Law (Federal Territories) Act.

Ngiam who was present in court said he was relieved that the dispute is over.

“It has been 18 days. I can’t sleep sometimes, it has been very traumatic,” said the father of two whose 54-year-old wife died on Dec 30 due to an illness.

Ngiam, a practicing Buddhist, said he hopes to claim his wife’s body this afternoon. The couple had been married for 28 years.

Visited a bomoh

Speaking on his wife’s ‘conversion’, he said it happened when the couple sought the help of a bomoh last year to cure her ailment.

“The bomoh‘s son videotaped my wife allegedly reciting some Islamic verses. This was done with bad intention, we had only gone there to seek treatment,” he added.

After his wife died, Ngiam went to the hospital to claim her body and was told that he could perform the Christian rites but must return Wong’s body to be buried according to Muslim rites.

The next day, he received a letter signed by the Islamic council’s director stating that Wong had converted to Islam on Dec 24 at a flat in Jalan Siakap, Cheras.

However, Ngiam disputed the declaration. He claimed that the council’s letter did not state his wife’s Muslim name and that the conversion was not done in accordance with the law.

He insisted that Wong was a practicting Christian.

On Jan 4, Ngiam was granted an interim injunction preventing the hospital from releasing Wong’s body to the Islamic council in an ex-parte application filed by Karpal.

Following the council’s letter to Karpal two days ago that Wong’s conversion is not binding, an inter-parte application to hear from both disputing parties scheduled for today before justice Lau did not take place.

Seek damages

In the council’s two-page letter, its legal unit head Eidey El-Nimeiry Mokhtar said: “We have carried out further investigation in relation to Wong’s conversion to Islam done by one Siti Aishah Ismail and from the investigation and statements recorded, we decided that her conversion was not valid.

“With that, we are not planning to pursue any action and we are relinquishing our right over the deceased’s remains for it to be handed to her husband.”

Meanwhile, Karpal said he will seek damages for the anguish suffered by Wong’s family as a result of the dispute.

“The council should be more careful in future to ascertain one’s conversion. They should not snatch a body, refuse to release it and later admit that it was not a lawful conversion.

“There could have been other (similar) cases in which this kind of injustice had occurred. We must be more sensitive,” he added.

Wong’s case was the latest in a series of similar disputes since 2005.

Hindraf 5 to begin hunger strike on Monday

Five Hindraf leaders will go on hunger strike beginning Monday to protest against being detained without trial after organising anti-discrimination protests.

The Hindu Rights Action Force (Hindraf) leaders were jailed last month under draconian internal security laws, after they enraged the government by holding an unprecedented mass rally.

Organisers said that the Hindraf leaders would fast for seven days from Monday, and would be joined by supporters across the nation who will hold an eight-day public hunger strike starting Sunday.

“The Hindraf leaders are going on a hunger strike and we want to show the people’s support for them,” M Kulasegaran, one of the lawyers representing the five detainees, told AFP.

He said the action was aimed at protesting against the detention of the five, and to demand an end to what they say is marginalisation of ethnic Indians in Malaysia.

“Prime Minister Abdullah Ahmad Badawi, who said he is willing to walk the talk and listen to the people, has all of a sudden used an old technique to silence the people,” said Kulasegaran, who is also an opposition politician.

The five are being held at the Kamunting detention centre in Perak, some 300km from Kuala Lumpur.

Held in isolation 16 hours a day

Kulasegaran said he met with the activists on Tuesday and that they were in high spirits but were being held in isolation for 16 hours a day and were denied access to reading materials.

He said that the public hunger strike would be staged in several locations across the country, including at a Hindu temple in Ipoh where some 100 participants were expected to take part.

Jeyakumar to take on Samy again

Parti Sosialis Malaysia (PSM) pro-tem central committee member Dr D Jeyakumar will once again vie for the Sungai Siput parliamentary seat in Perak, the stronghold of MIC president S Samy Vellu.

This will be his third attempt to dislodge the MIC strongman from the seat after having failed in 1999 and 2004.

In a statement issued today, PSM’s national election committee said it decided that Jeyakumar (right) is the best candidate for a duel with Samy Vellu in the coming general election.

“Jeyakumar is seen as the most serious, laudable and creditable candidate to take on Samy Vellu. The decision to field him again was achieved after many quarters felt that this is the right moment to oust Samy Vellu.

“It is important for the opposition to field a candidate with the capacity to defeat Samy Vellu who has been holding on to the seat for the last 33 years,” said the committee.

Hindraf effect

The MIC president has come under intense pressure following the emergence of the Hindu Rights Action Force (Hindraf).

The situation reached a critical point when some 30,000 people took to the streets to participate in a rally organised by Hindraf on Dec 15.

While five Hindraf leaders have since been locked up under the Internal Security Act (ISA) after being slapped with a slew of accusations, including having terrorist links, the rally led to a widespread debate on the status of the Indian community in Malaysia.

MIC and its veteran president were also thrust into the limelight as critics blamed the party’s alleged ineffective representation as having contributed to the many woes faced by the community.

Political observers have noted that support for MIC at all levels has been waning and this in turn could translate into a loss of votes. There are also talks of internal splits in the party over this issue.

However, MIC leaders have repeatedly stressed that the party is strong, united and its support base unaffected.

Credible performance

Meanwhile, Jeyakumar, who is also PSM Sungai Siput branch chairperson, had put up a credible performance against Samy Vellu during the 2004 general election. He also contested against Samy Vellu in 1999.

In the three-cornered fight which also involved DAP candidate Samugam Ponmugam, the PSM leader who stood under a PKR ticket garnered 8,562 votes. Samy received 18,797 votes whereas Samugam 2,864.

Sungai Siput has 46,783 registered voters.

Contacted later, PSM pro-tem secretary general S Arutchelvan also reiterated that Jeyakumar is the best man for the job.

He also said that the yet-to-be registered party was still undecided on whether Jeyakumar should stand under a DAP or PKR banner.

However, Arutchelvan said PSM welcomes either option if it means a straight fight between the opposition and Barisan Nasional but in the event of a three-cornered fight, the party would opt for the PKR banner.

“We have an agreement in Selangor to run under the PKR banner. So we want to follow the same understanding in other states too,” he added.

Arutchelvan said he would be contesting for the Semenyih state seat while party pro-tem chairperson Dr Mohd Nasir Hashim will be contesting for the Kota Damansara state seat.

Both the seats are in Selangor and Arutchelvan believes PSM has sufficient grassroots support in these areas.

He also added that the party has reached an understanding with other opposition parties in Selangor and expects an agreement to be finalised in February.

As for the situation in Perak, he said things still “look messy.”

Back To School 2008 @ Bkt Darah and Bukit Rotan

After about 3 weeks of preparing for Back to School 2008, the organisers descended on SJKT Bukit Darah and SJKT Ladang Sungai Buloh, Bukit Rotan for the handing over of bags and uniform to the students. The trip to Bukit Darah was on 6th January while Bukit Rotan trip took place on 1oth January.

The project expanded from 76 students to 92 students including the kids from the single parent families that UMIC is helping.

Photos from the trip to the two schools are available at the moment, while photos from the visit to SJKT Ladang Bradwall, Siliau, Seremban haven’t reached me yet.

MIC to field young candidates

SV already sensed that some of the oldies have been rejected by the people. so, no choice but to field new faces.

He said many Indians were involved in unhealthy activities such as crime, mainly because of insufficient employment and educational opportunities.

MIIC to field several 'young, energetic' candidates

IPOH: The MIC will make major changes in its list of candidates for the upcoming general election.

Party president Datuk Seri S. Samy Vellu said yesterday several new faces would be in the list.

He said this would include the "young and energetic" but warned that the candidates needed to be intelligent, approachable and equipped with the "necessary qualifications" as well. "Nominating young members as candidates does not mean that all new faces will be youngsters. It will be a mixture of old and new faces. "The candidates should be responsible and be able to work hard to upgrade the socio-economic status of the community," he said before meeting Perak MIC division and branch leaders here yesterday.

On the meeting, Samy Vellu said it had nothing to do with the general election but to "entrust them with duties and services to keep abreast with the current political scenario". "The role of leaders must be in line with the needs of the community and members must bring forth new ideas for the future and not be left behind with outdated approaches."

Samy Vellu said a conference to be attended by leaders from the 3,600 MIC branches would be held in Kuala Lumpur on Feb 3. Several resolutions on education and the economy would be tabled at the conference which will be opened by Deputy Prime Minister Datuk Seri Najib Razak.

Earlier in Kuala Lumpur, Samy Vellu said the MIC had drawn up a three-pronged plan to help the Indian community and steer the young away from undesirable activities. He said the plan, to be implemented over the coming months, would stress vocational and skills training for the youth and helping Indians in business.

He said many Indians were involved in unhealthy activities such as crime, mainly because of insufficient employment and educational opportunities.

"I will meet youth from Cha'ah in Johor, Sitiawan and Teluk Intan in Perak over the next two months to understand their problems and seek their views."
