This case keeps on dragging, from last November until September is 10 months! Probably can celebrate first year anniversary for the case. Anyway, note that Star mentioned 66 people while NST stated 69 people under trial.

SHAH ALAM: The 66 Hindu Rights Action Force (Hindraf) supporters charged for allegedly participating in an illegal assembly at Batu Caves on Nov 25 will have their case heard at the Sessions Court here in September. Judge Azimah Omar fixed Sept 15 to 19 and Sept 22 to 26 for the trial, which is expected to see about 80 witnesses brought in to testify against the defendants.

Sixty-four of the accused also face an additional charge of causing mischief by damaging seven vehicles at the Batu Caves Sri Subramaniar temple premises between 1am to 8am on the same day. Initially, 69 people, including five students, were arrested and separately charged in Shah Alam and Selayang courts last December. The prosecution withdrew the causing mischief charge against the five students but maintained the charge of participating in an illegal assembly against two of them. The remaining 64 people face both charges.

Deputy public prosecutor Nik Suhaimi Nik Sulaiman told Azimah that the Attorney General’s Chambers was also considering the representations made by the defence team on the charges brought against the accused. All 66 are on RM500 bail with one surety each and have to report to the nearest police station once a month.

The Sessions Court has set Sept 16-26 to try 69 people charged with participating in an unlawful rally organised by the Hindu Rights Actions Force in Batu Caves last year.  Judge Azimah Omar fixed the date after Deputy Public Prosecutor Nik Suhaimi Nik Sulaiman applied for the court to fix the trial date for all the accused.

Attorney General Tan Sri Abdul Gani Patail had yet to decide and was still considering a representation by defence counsel G. K. Ganesan about the case, he said today. Ganesan did not object to Nik Suhaimi’s application and sought cooperation from the prosecution to give him all records and documents relating to the case.

Nik Suhaimi said between 80 and 100 witnesses would be called.  At today’s proceedings, one accused – S. Ganeshen – did not turn up. Following this, judge Azimah issued an arrest warrant on him. The judge also cancelled arrest warrants issued on K. Panirselvam, N.

Markanda, M. Vijendran and N. Gobala Krishnan who were absent during March 4 proceedings, after they furnished sick certificates.

All the 69 people are charged with participating in an unlawful rally and showing force to intimidate on duty police officers at the Sri Subramaniar Temple in Batu Caves between 1am and 8am on Nov 25 last year. The charge under Section 27(5) of the Police Act 1967, carries up to a year’s jail or RM10,000 fine upon conviction.

    well they’re game plan is simple….
    if they convict the detainees , it will hurt the 1.8mill Makkal whom had just thought the authority a lesson last March8.
    if they dun convict the detainees , they wont satisfy themselves in the name of “ketuanan”….

    they’re dragging the time as a precaution where it will be forgotten by Indians …they’re probably applying the concept of ‘India mudah lupa’ ….
