Hindraf candlelight vigil for Balasubramaniam

Hindraf have joined the Balasubramaniam bandwagon by organising a candlelight vigil tonight at Brickfields. Bala’s nephew revealed that Bala had made contact with him (Kumaresan) late last night via a short telephone call.

For about 20-minutes, some 40 individuals who took part in the gathering chanted “Where is Bala?”, “We want Bala”, “IGP, free Bala” and “Najib, don’t hide Bala” among other slogans. Two PKR MPs – S Manickavasagam and R Sivarasa – were also at the vigil to lend support to the gathering.

Manickavasagam warned that Hindu Rights Action Force (Hindraf) would hold a demonstration if the missing private eye was not found by this weekend.

Elangesvaran fond of Lord Ganesha

Selvam told Malaysiakini that Elangesvaran was never a Muslim and had always been a practicing Hindu.

 

My stepbrother has special affection towards Lord Ganesha (the Elephant God)

However the judge ruled that:

 

the High Court has no jurisdiction to decide over an earlier Syariah Court ruling

This despite the fact that no proper proof was submitted on the conversion.

Their family’s lawyer, Karpal Singh will however go ahead with an appeal to the higher court to seek a landmark decision “to once for all end controversies arising from cases of this nature.”

He believed the grounds for Balia’s decision could be challenged since Syariah Court’s jurisdiction covers only Muslims and it could only make rulings on Islamic apostasy, “not when it involves a person’s religious identity.” “Only civil courts can rule on whether a person is a Muslim or not,” he told journalists outside the chambers.

Karpal said it was wrong for the Perak Islamic religious authority to file for a decision at the Syariah Court when the case was pending at the Penang High Court, thus putting “unwarranted and undesired” pressure on judge Balia.

“It was a direct interference by the Syariah Court into the judicial powers of the civil court.”

Meanwhile HINDRAF representatives expressed shock over the ruling:

 

Describing the decision as shocking, Hindraf national coordinator RS Thanenthiran suggested that “Syariah Court seems more powerful and prevailing over civil courts when the federal constitution says otherwise. This is injustice to Elangesvaran family and the Hindu community at large. “I urge the Appeals Court to make an ultimate and fair decision to put to rest this persisting controversy,” he said.

Hindraf Perak coordinator A Vethamurthy said the decision today implied that “it was waste of energy, time and resources for non-Muslims to seek justice through the civil courts.”

I think there’s something more sinister to this story. Who is Elangesvaran? Why is he important until the religious people want to snatch his body without providing any proof? Why did Elangesvaran continue living with his non-Muslim wife if indeed he converted? Why did he commit suicide knowing that suicide is a big sin in Islam? Will the religious hooligans try to snatch the children as well citing that Elangesvaran already converted them? His wife better send the kids overseas as a precaution.

HINDRAF 5 to remain in ISA

The advisory board which met recently recommended to the Home Ministry that the Hindraf 5 to be kept in detention since their view have not changed.

This is expected. It is highly improbable for the 5 detainees to change their views. I don’t think bribery or coercion will work. Only option is threat, but such actions will leak out, thus defeating the purpose. So, we can foresee these guys to be in Kamunting for a longer period. Unless of course there’s a change in the government’s stand or the government itself. Or if the Minister decides otherwise.

 

According to Syed Hamid:

Charging someone in court will mean putting all the evidence and testimony in the open. “To avoid exposing intelligence-based information, we will detain a person under the ISA”

Well, I think in this case, there should another mechanism to verify the authenticity of the information. Currently, the discretion lies under one person. Perhaps a permanent commission should be created to evaluate each and every case to ensure there’s no misuse of power.

62 detainees are kept under ISA:

5 – Hindraf
2 – separatists from south Thailand
7 – foreign intelligence agents (!)
17 Darul Islam militants
25 Jemaah Islamiyah militants

Another 6 unknown.

 

Syed Hamid said Hindraf was an extremist group because it was not registered. Hmm…that’s a new definition! That means there’s plenty of extremist groups out there 🙂 While at Kamunting he met with Manoharan, Vasantha Kumar and Ganabatirau. When he suggested that their release would continue to cause public disturbance, the three did not agree.

 

According to the report, Syed Hamid did not meet with Uthayakumar or Kengadharan. He said the former did not mix much with anyone, while the latter was spending time with his family members who had come for a visit.

HINDRAF ISA detainees ask to be released

As financial difficulties start to sink in, the lawyer for the ISA detainees, Karpal Singh had argued for their release at the six-month review by the advisory board.Among the reasons are:

  • poor health (Uthayakumar)
  • their desire to return home
  • they did not pose a security threat
  • the hardship faced by their families due to their long absence from gainful employment

“If not released unconditionally, they should at least be released with conditions, so that they can return to their families and their work.”

As provided under Section 13 of the Internal Security Act 1960, the advisory board at Kamunting is to review the detention order every six months, by listening to detainee testimony and considering reports by Special Branch and that filed by the detention centre. The board, with chairman Yaacob Sam and two other civil servants, will present its report to the home minister.

HINDRAF not helping Vasantha Kumar’s wife

This is a damaging statement to HINDRAF. They better clarify this remarks from Ms Vickneswary, wife of one of the 5 HINDRAF ISA detainees, Vasantha Kumar.

I am both disappointed and saddened as I have been left in the lurch
and receive no help or moral support from my husband’s Hindraf
counterparts

She claims that her most of husband’s Hindraf friends have abandoned her and her two daughters. According to her, other than Ganabathirau’s brother V. Raidu, none of the people currently
front-lining Hindraf had called or visited her. She finds it difficult to travel to Kamunting every weekend on her own, with two kids on tow.

According to Vickneswary, her husband was also disappointed
when she told him that only one or two of his Hindraf friends’ had
bothered to find out how she and their two children were doing.

Vickneswary
also said she was not receiving any financial aid from Hindraf and
added that she sometimes felt that her husband’s efforts and sacrifices
were in vain.

Vasantha Kumar’s house also went under auction recently.

I await their reply.

HINDRAF had clarified recently that they are not collecting any funds.

If we can remember, Vasantha was the one who was pressured by the police to admit to collecting money to fund terrorist activities. But Vasantha lodged a police report saying he was pressured to do so..
