Indira to get her kids

She was skeptical until its in black and white. She wants to see her kids original names and religion on paper. The cabinet can say thousand and one things, but law is law. She is right.

Today, the Ipoh High court granted Indira interim custody of her three kids. It also granted injuction preventing her husband from entering their home. Does it mean the Jabatan Agama fellows can enter?

Judicial Commissioner Ridwan Ibrahim, who presided over the matter in chambers Friday, also ordered the police to assist Indira Gandhi in carrying out the court’s orders.

He set May 12 for an interparte hearing of the matter, to allow Indira Gandhi’s husband, K. Pathamanathan, 40, to give his side of the story.

When met outside the courtroom, Indira Gandhi’s counsel Augustine Anthony said the judicial commissioner had granted all requests listed in the originating summons.

He said that the matter of the children’s religion would be handled at a later date, pending the court’s decision after May 12.

When approached, a tearful Indira Gandhi said she was very happy with the court’s decision.

“But I will be even happier once all my children are finally with me,” she said.

The police are asked to assist Indira in getting back her baby and the husband is not allowed access to the kids without her permission.

Lawyers agree with the fact that a cabinet directive is just that – a directive:

Meanwhile, lawyers A. Sivanesan and M. Kulasegaran, who are also assisting Indira Gandhi in the case, said the Cabinet’s decision Thursday on conversion should be turned into a law.

“A directive has no legal effect in the court of law. It may be persuasive in court but again, it has no legal effect,” said Sivanesan.

Kulasegaran said the Religious Department could choose to ignore the Cabinet’s decision for a directive was “no different from mere advice”.

The Cabinet decided on Thursday that the children of parents who are divorced and where one parent converts to another religion have to be brought up in the ”common religion at the time of marriage.”

I was wondering when the protest will come, and it not surprisingly, the Syariah Lawyers have expressed shock over the Cabinet directive. Well, serves them right. All this while, they were not following justice and were shaking legs when conversion problems occur. How many families suffered? Where were they then?  Now want to express shock??? We have a chance to fix the problem, so these fellow should zip it. If can’t help, then just keep quiet.

Anyway, I expect the problem to get bigger as more and more “NGOs” representing their religion voice their unhappiness. According to Perak Mufti:

Perak Mufti Datuk Seri Harussani Zakaria has urged the government to get views from the Malaysian Mufti Council before making any decision regarding Islam to avoid confusion.

He said the government decision that a child’s religion must be in accordance with the common religion of the parents at the time of marriage should have been discussed by the council beforehand.

“In Islam, when the father or mother is a Muslim, the child automatically becomes Muslim unless the child is above 15 years of age and can choose his own religion,” he said here today.

But in Hinduism, every soul is an Hindu. So how? If we follow track of whose religion is greater, it will be a neverending problem as I will say my religion is the truth, while another fellow will claim his is the true one. The only solution, ensure we all agree on common law. Any fellow want to convert, force him to come clean. Don’t create problem for the rest of the people, especially the family. Don’t insult or embarass your new religion until people look down on it.  I hope their religious people can see some light and think practically.

Lim Guan Eng to sue Utusan over inter faith council

Well, Malaysiakini report says that Penang Chief Minister Lim Guan Eng has denied a report in Utusan Malaysia today that the state had established an inter-faith council last year.

“These are lies…we have no such council,” he told reporters in Parliament today.

Thus, his lawyers will be file a defamation suit against the daily.

“And if they have any evidence of us setting up such a council, then bring it to the court,” he said.

The paper published the news on front page today:

Utusan Malaysia today published a front-page lead stating that the DAP-run government in Penang was insulting Islam with the setting up of the inter-faith council.

The daily quoted the Penang Islamic Council chief Shabudin Yahaya as saying that the inter-faith council must not be allowed to be established as it would place Islam on par with the other religions.

This, said Shabudin, was an insult to Islam.

The daily said that the inter-faith council was headed by Lim and three-Malay members as well.

NIBONG TEBAL 23 Feb. – Penubuhan Majlis Perundingan Antara Agama oleh kerajaan negeri Pulau Pinang mesti dihentikan kerana ia meletakkan Islam sama taraf dengan agama-agama lain.

Yang Dipertua Majlis Agama Islam Negeri Pulau Pinang (MAINPP), Shabudin Yahaya berkata, cubaan menyamakan Islam dengan fahaman agama lain ternyata menghina Islam dan tindakan seperti itu mesti dihentikan.

Katanya, MAINPP berasa cukup tersinggung apabila ada beberapa ahli jawatankuasa (AJK) majlis tersebut terdiri daripada orang Melayu.

‘‘Saya difahamkan ada tiga orang AJK Melayu beragama Islam duduk dalam majlis tersebut yang kononnya mahu menuntut kesamarataan agama.

‘‘Ini sesuatu yang cukup menakutkan kerana agama Islam dipandang sama seperti Buddha yang diasaskan oleh manusia bernama Gautama Buddha, disamakan juga dengan Kristian, Taoism dan Bahai,” katanya.

Beliau berkata demikian kepada Utusan Malaysia ketika diminta mengulas ucapannya semasa majlis penyerahan Dana Zakat Program Didik Cemerlang Akademik 2009 di Sungai Dua di sini semalam.

Ketika berucap pada majlis tersebut, Shabudin melahirkan rasa kurang senangnya terhadap penubuhan Majlis Perundingan Antara Agama Pulau Pinang yang bertujuan meletakkan semua agama, termasuk agama Islam sebagai sama rata dengan agama-agama lain.

Majlis tersebut ditubuhkan tahun lalu iaitu selepas kerajaan pakatan pembangkang yang diterajui Ketua Menteri, Lim Guan Eng mula memerintah negeri itu.

Majlis itu dipengerusikan Guan Eng sendiri. Mengulas lanjut, Shabudin yang juga Ahli Dewan Undangan Negeri (ADUN) Permatang Berangan, Tasek Gelugor berkata, agama Islam itu tinggi dan tidak ada yang lebih tinggi daripadanya.

Looking through my archives, I found that Guan Eng did mention setting up a council, but the name is different:

We have also formed an inter-religious council called Majlis Silaturahim to promote goodwill and understanding among all religions

Its from the Star article dated 23 June 2008.

Is there a difference between “inter faith council” and “inter-religious council”, or in Utusan’s report “Majlis Perundingan Antara Agama” which translates to inter-religious consultation council”?

BTW, isn’t the Majlis Agama Islam Pulau Pinang under Penang state government authority?

Body Snatching blamed on MyKad

PRESS STATEMENT : MHS Saddened By Confiscation Of Body.

The Malaysia Hindu Sangam (MHS) is gravely disturbed to understand that the body of a deceased man, a practicing Hindu, has not been released to his wife and family for final rites. MHS is informed that the body is being retained by the Serdang Hospital mortuary upon the interference by Islamic Authorities, who have claimed that the deceased is a Muslim.

Mr Amaran was killed in a road accident on 15th February 2009, and his body was sent to the Serdang Hospital for post-mortem. His wife, Valarmathi, was shocked when informed by the hospital mortuary that her late husband’s body could not be released to her for Hindu funeral rites, as the authorities had laid claim to his body for Islamic burial rites instead.

His family maintains that Amaran has been a practicing Hindu all his life. He was married according Hindu ceremonial rites, and his marriage was also recorded in the Civil Registry as him being a Hindu. His children are also registered as Hindus. The family has explained to MHS that when Amaran changed his identity card to the new MyKad, the National Registration Department had erroneously listed his religion as Muslim, when in actual fact he was a practicing Hindu. He had notified the department of this at the time.

This situation is most disturbing and goes against the grain of the spirit of dialogue that has been ongoing between MHS and ACCIN (the Allied Coordinating Committee of Islamic NGOs). This dialogue has been aimed at overcoming conflicting situations such as this from arising, as has been experienced in several prior incidents.

The MHS strongly urges the authorities to immediately release the body of the deceased to the wife and family, so that they may be able to placate their grief on their loss, by completing the necessary funeral rites.

Let the family be at peace. The true spirit of Muhibbah must prevail.

So, there will be a rush to check our MyKad using Astro decoder dish.  Unless some sordid secret life of the deceased appears, it appears that for all purposes and intent, the deceased is an Hindu.

What the family should do now is get an court order to stop any body snatching and then get some documentation from Registration Dept showing that the error in religion was highlighted prior to his death. I find it ridiculous that just based on the MyKad the so called “authorities” can claim the body. What about proof of conversion? Is there any document in the state religious departments? Are there any witnesses to his conversion? Or was he actually born as a Muslim but the truth hidden from everyone.

I had heard one case where the deceased was a convert (happened in university due to love). But the guy hid the truth from everyone except his mother. The mother married him off to a Hindu lady and they had a kid. When they went to register the baby, the truth came out that her beloved husband was a Muslim.  The wife was forced to convert to Islam in order to keep the children (someone misled her at that time). All the children are now muslims and one of them is getting married to a Malay. The mockery of it is that they don’t practise any of the Islamic tenets. Name only muslim,  but the lady goes to temple and wears her Thali.

The principal of a secondary school here is in trouble for an alleged religious slur against his students.

More than 20 parents of the school’s students gathered outside the district education office here to demand an apology yesterday.

They claimed the principal had used the derogatory words thrice during an assembly on Sunday.

One of the parents, Y. Baskaran, said the principal should set a good example by fostering unity among students.

“The principal’s action is an insult to the community. She should have refrained from using such words. I hope no one in responsible positions like her uses the words in future,” he said.

Several parents had also lodged a police report the day after the incident.

Baskaran said narrow-minded civil servants such as the principal were obstructing the government’s efforts to promote racial harmony in the country.

Baskaran, who represented the parents, handed a memorandum to district education officer Abu Bakar Md Ali.

Social worker S. Neelamegam, who was present at the gathering, said disciplinary action should be meted out to the principal to serve as a lesson to other civil servants.

Abu Bakar said he would refer the matter to the state Education Department.

And then, this incident in Kuala Langat.

Don’t be surprised if the HM gets promoted and transfered to a Cluster school! 🙂

Rihanna under ISA

Looking at the threat Rihanna poses, why not we allow her into the country, and then put her in ISA to be counseled and reformed? Can we use ISA on foreigners? 🙂 (It’s a joke in case some people don’t get it)

Let’s look at the reasons given by PAS FT Youth:

1. the concert “does not match with the local culture”

2. having Rihanna in Malaysia is a “disgrace to Asian culture”

3. Israel’s ally, the United States, is funded by its public and this includes Rihanna who is currently living in California. It can be considered as supporting Israel’s military offensive in the Gaza.

4. “It doesn’t matter if Rihanna is involved in the issue, but to us (PAS), she is an agent of polluting young peoples’ minds around the world through her songs.”

5. campaign of boycotting US products including their artistes must go on.

6. PAS youth wing will consistently protest against concerts that does not portray the positive Asian culture and which might create social problems in the country.

And more in Star:

7. inviting the Barbados-born singing sensation to Malaysia was “akin to insulting eastern culture, belittling local artistes”…

8. the Grammy award winner to be unsuitable because she often performed suggestively and wore skimpy, sexy outfits.

9. local concert sponsor Celcom should give priority to eastern cultures and local artistes.

10 .Rihanna’s appearance here would result in an outflow of local currency to the United States, and in turn, cause loss to the country and suffering to the Palestinians.

I believe there are more Malaysians who are a disgrace to Asian culture if we judge by their dressing. One can just flip through magazines like Tattler. Or just spend some time in happening places like Bukit Bintang, Hartamas or the various hangouts at hotels. If its too difficult to do, just visit any of the shopping complexes and observe the dressing and behavior of both Malaysians and foreigners. PAS will have a field day sending protest letters to every ministry in town!

This “boycott USA” thing is getting out of hand with selection persecution implemented. Why not we ban all workers, students and tourists from USA? By extension, why not ban all foreigners whose countries deal with the USA since these countries indirectly contribute to the coffers of USA? Why not we ban exports to USA and countries that trade with USA?

And really, why are we getting paranoid with Palestine when our own backyard is stinking so much? Yeah, those people are suffering and we share their sorrow. We donate money and we sympathise with them.

I don’t agree with PAS confusing their Middle East religion with “Asian culture”. They have no right to represent Asians like myself who do not profess their religion. In fact, they can’t represent about 40% of Malaysians and loads of foreigners who are working here. PAS is intruding dangerously into the private lives and freedom of people who are not connected in anyway with its ideology or religion.  Instead of butting its nose every where, just focus and counseling or educating the followers of your religion. That is the correct way, in my opinion.

Looks like PAS is becoming number one enemy of Rihanna fans throughout the world.

BTW, I have not heard any of this singer’s songs nor am I promoting her concert, but I find  it hard to accept PAS’ logic.
