Scores of police roadblocks have been sighted across Selangor on roads leading to Kuala Lumpur, causing major traffic jams. Malaysiakini received information that roadblocks had been set up since this morning bringing the rush-hour traffic to a crawl. Selangor Traffic and Public Order Department chief Supt Che Hussain Che Omar, when contacted, said roadblocks have been set up in all 12 districts in Selangor. “It is for crime prevention. We have placed roadblocks in all major strategic area this morning. When it will end depends on the situation. We still study the situation,” he said. More than a week ago, similar roadblocks were set up to frustrate thousands of people from attending the Bershi rally demanding for free and fair elections. However, despite the lockdown, about 40,000 turned up in downtown Kuala Lumpur. Show police presence A police source confirmed that the roadblocks have been set up to block those attending the Hindraf rally. “We just want to show police presence in the areas,” said the source, who requested anonymity.
Roadblocks were spotted on several highways including the Silk Highway (from Kajang and Semenyih to Kuala Lumpur and Putrajaya), near Sungai Ramal, Sungai Besi Highway (photo) and Sungai Way on the Federal Highway. Other areas include Ampang (at Taman Dato Ahmad Razali before Ampang Point and another at Gleneagles Intan Medical Centre), Jalan Puchong (near Bintang supermarket), Klang (Bukit Tinggi and Bukit Raja) and Bukit Mertajam in Penang. Heavy police presence has also been sighted in Ampang and in Kampung Cheras, the latter being an Indian predominated area.
In a statement today, Hindraf chairperson P Waytha Moorthy advised those attending the gathering to leave their homes early. “There may be roadblocks and the presence of Federal Reserve Unit. They may hinder you from proceeding to the venue," he said. “Insist upon them that you are exercising your rights under Article 10 of the Federal Constitution and Article 20 (freedom of assembly) of the Universal Declaration of Human Rights 1948." Volunteer arrested Hindraf has not been issued a police permit for the rally after Cheras police chief Ahmad Amir Mohd Hashim rejected the application for technical and safety reasons three days ago.
Hindraf legal adviser P Uthayakumar told Malaysiakini that their appeal to Kuala Lumpur police chief Zulhasnan Najib Baharuddin was rejected today. He also said that a Hindraf volunteer S Tanendran was arrested in Puchong at about 4pm for taking photographs of the roadblock. “They have taken him to the Puchong Jaya police station now,” said Uthayakumar. “Is it an offence to take photographs?” asked Uthayakumar, adding that he was not given a satisfactory response by the police office in charge of the district, ACP Zainal Rashid Abu Bakar. “He merely said that he would investigate the matter,” said Uthayakumar, who also said that his staff and volunteers in his office have been receiving threatening phone calls over their involvement with Hindraf. Petition to the Queen The gathering is expected to attract 10,000 people, with Hindraf to hand over a petition addressed to the British Queen to support a class-action suit against Her Majesty's government for bringing Indians to Malaysia as indentured labourers and exploiting them for 150 years. The quantum being sought is US$4 trillion (RM14 trillion) – or US$2 million for every Indian currently residing in Malaysia. The gathering has sparked rumours via the short messaging service on mobile phones that Queen Elizabeth II will make an appearance at the British High Commission in Kuala Lumpur on Sunday, but this has been dispelled by Hindraf. Other rumours are that that Uthayakumar has been beaten up and the lawyers in Hindraf has been arrested. These have also been clarified as false. |

nazri says civil and syariah powers are clear
November 20th, 2007(In the case, the Federal Court held that the civil and syariah courts must determine first whether either had jurisdiction over a matter. Judge Abdul Hamid Mohamad ruled that if one of the parties in a dispute was non-Muslim, the syariah court did not have jurisdiction over the case even if the subject matter fell within its jurisdiction.)
what does this mean? Subashini ( here and here too) can pursue her case in civil court?
No need for clarification on civil, syariah laws: Nazri
http://sun2surf.com/article.cfm?id=20007
KUALA LUMPUR (Nov 19, 2007): The government will not amend the Federal Constitution to clarify the position of syariah and civil laws in the country because there is no necessity to do so, Minister in the Prime Minister’s Department Datuk Seri Mohamed Nazri Abdul Aziz said today.
He said this was because the powers of both civil and syariah courts are clearly provided for by the Federal Constitution, particularly under Article 121(1) and (1A), and in the Federal List and State List of the Ninth Schedule. "Based on several decisions of the Federal Court, it is clear that there is no necessity for the government to amend the Federal Constitution," Nazri said. Replying to a question from Datuk Kamaruddin Jaafar (PAS-Tumpat), he said the matter was quite clear as was decided by the Federal Court recently in the case of Latifah Mat Zin v Rosmawati Sharibun and Roslinawati Sharibun.
(In the case, the Federal Court held that the civil and syariah courts must determine first whether either had jurisdiction over a matter. Judge Abdul Hamid Mohamad ruled that if one of the parties in a dispute was non-Muslim, the syariah court did not have jurisdiction over the case even if the subject matter fell within its jurisdiction.)
"The Federal Court decided in this case that matters involving Muslim law falls under the power of the Syariah Court as is clearly provided under List II of the Ninth Schedule of the Federal Constitution, as well as subsection 61(3) of the Islamic Administration Enactment (Selangor) 2003," Nazri said. He added that in this case the matter of overlapping jurisdiction between the syariah and civil court did not arise at all.

Get all S’gor officials to declare assets
By DHARMENDER SINGH
KLANG: Sungai Pinang state assemblyman Teng Chang Khim wants to push a bill that would require all selected representatives and appointed politicians in Selangor to declare their family assets.
He has submitted a notice to the State Secretary for a motion to table the proposed Declaration of Family Income and Asset Bill 2007 to make this compulsory.
Teng said the proposed Bill would cover the mentri besar, state executive councillors, state assemblymen, state senators and local government councillors as well as their spouses.
The declaration, he said, would then have to be gazetted and made public, adding that anyone with information on assets or income that had not been declared could report to the authorities.
He said the notice was submitted on Nov 5, giving the state government ample time to discuss it at the state executive council meeting and to decide if it would be tabled at the next state assembly sitting, which begins on Nov 19.
“The need to make it compulsory for all politicians to declare their income and assets has been discussed for a long time and it is time to finally implement it," he told a press conference here on Wednesday.
Under the proposal, anyone making a fraudulent declaration would face a minimum jail term of one year and one day or a minimum fine of RM3,000 which is enough to make an assemblyman lose his seat.
Happy Deepavali!
November 13th, 2007
I know its kind of late, anyway, to all Hindus readers, belated Deepavali naalvalthukal (Happy Deepavali)! May the spark of godliness in us remove veils of ignorance and ego in us. Let us strive to illuminate our lives and also of those around us.
As with most Hindu families, the eve was spent having prayers for the demised.
On Deepavali day, we were at my parents house for prayer, followed by visit to Then’s hometown. The next few days were spent visiting relatives around Klang Valley.
One of the conversation topic wherever we went was the temple demolition at Padang Jawa which was not highlighted in media, except in tamil papers for the first few days. Most of the people I met were extremely unhappy about the issue, and condemned Selangor government and MIC for this. I think BN have lot of salvage work to do in the coming elections.
Perak never rejected application for temple land titles
November 13th, 2007Apply for land titles, temples told MIC: State has never rejected applications
By CLARA CHOOI
Perak MIC chairman Datuk G. Rajoo said he was confident the state government would not reject their applications, as it had not done so before.
“Since 2000, the state has issued land titles to 38 temples,” he told reporters at his Deepavali open house in Ipoh recently.
His comments came following the demolition of a temple in Shah Alam by the Selangor Government on Oct 30 that sparked off a controversy.
On the 38 temples issued land titles, Rajoo said, some had been allowed to remain in their current location while others were given alternative plots of between 0.404ha and 0.808ha.
“The state government also gives an RM300,000 annual allocation for the maintenance of the legalised temples,” he said.
Despite this, he said, there were still so many illegal Hindu temples in Perak.
“This is because the temple committees are not willing to move from their current locations. They do not apply for land titles as they may be asked to relocate to a new spot,” he said.
He added that in Ipoh alone, at least 400 Hindu temples were squatting illegally on government land.
“Still, Perak has never demolished temples to make way for development,” he said, adding that with negotiations, such problems could be resolved amicably.
“However, we would like to urge all temple committees to legalise their temples and apply for the grants.
“They must register their details with the Malaysia Hindu Sangam and their applications can be sent to the state government through the Perak MIC,” he said.
Earlier at the open house, Rajoo donated RM5,000 each to six orphanages in Ipoh.
