Hindraf to sue Utusan

Probably Hindraf should sue all those ministers who commented as well 🙂 Waytha dares the media to publish proof of the unruly behavior of Hindraf supporters who attended the Hari Raya open house at PWTC. So, far photos in Malaysiakini and those received via email paint a different story compared to the yarn spun by Utusan.

Waytha says:

So visiting the PM on a Hari Raya (Eid) is a grave sin committed by HINDRAF. An act of betrayal and insult to the Islamic religion. the masterminds should be arrested under the ISA or prosecuted under the existing Laws – so say the Malay extremist and fundamentalists organisations. Cabinet Ministers claim HINDRAF was extreme in barging into the PM’s open house and presenting a memorandum. Their seditious criticisms. were carried out by the none other than the UMNO controlled daily Utusan and TV3.

So it was a grave sin. I challenge these fools to obtain evidence from over 30 odd TV crews and pressmen (both local and International media) and the numerous Police Special Branch units who covered , recorded and filmed the entire episode to make public their recordings so that the whole world could see the foolishness and low mentality of Malaysian politicians and their UMNO coolies who stir up racial sentiments for their own political survival.

There is no doubt that whenever there are serious problems within UMNO, the best solution (idiotic though) is to stir racial tension among races. UMNO creates problems and misleads the public with the strength and might of their media.

This card is interpreted by the Cabinet Ministers as memorandum. I wonder if they know what they are talking about. The simplest greeting card prepared by a 6 year old with the help of adult to express the feeling of HINDRAF supporters to the PM-And this is interpreted as an insult to the Islamic faith???

Now, there’s a possibility of Utusan getting a RM1 million lawsuit soon. Malaysiakini reports that the issue is being discussed by HINDRAF lawyers. National coordinator RS Thanenthiran said that HINDRAF was very disturbed by the Utusan reports which he claims were tainted by lies and distorted facts.

A commentary in Utusan by Baharom Mahusin deserves a police investigation or even detention under ISA due its contents. I guess the writer may need police protection.

Hindraf was particularly offended by Baharom’s comment which stated that ‘ Kalau penyokong Hindraf melakukan penghinaan seumpama itu di kawasan-kawasan pendalaman yang menjadi kampung halaman orang Melayu, mereka sudah pun diajar tentang makna dan akibat berperangai kurang ajar.’ (If Hindraf supporters pour such insults in the interior areas dominated by Malays, they would have been taught a lesson on the meaning and consequence of misbehaviour.)

Thanenthiran asked, “What is the writer trying to instigate here?
‘Communal conflict? Racial hatred?”.

“Baharom’s comment was most unprofessional and unethical”, Thanenthiran told a press conference in Butterworth.

HINDRAF also chastised and ridiculed the Home Minister and others who did not understand the difference between Hari Raya card and a memorandum.

Charles Hector raised a similar question to mine in his blog – Why no coverage of the Free RPK group nor a warning to them in Utusan and NST? Is it discrimination? He also wrote few more important points.

Utusan, meanwhile, continuous with its tirade. The protection and freedom given to this paper is unprecedented. If this was some other paper, it would have closed shop ages ago. On Saturday, Utusan says “Hindraf diberi amaran” (HINDRAF warned) which reported on Home Minister hinting that the illegal organization (no other paper uses the word “illegal”) HINDRAF faces police investigation over the Raya visit. The article in Utusan is really an insulting peice of work. I won’t bother reproducing it here lest people start to burn Utusan paper in public or throw cocktails (Is it the trend nowadays?). I guess even ISA may be used against the key persons. Among the names being bandied about was Shanti, Waytha’s wife and Thanenthiran, the National Coordinator. I guess even the 6 year old daughter may be detained as potential future threat! Other articles in Utusan with similar hateful words are here and here. Take a deep breath before reading them.

Meanwhile Samy says he will continue to fight for the release of Hindraf 5 even with the “problem” given by HINDRAF.

He said he was taking “other action” besides appealing to Prime Minister Datuk Seri Abdullah Ahmad Badawi, Home Minister Datuk Seri Syed Hamid Albar and the BN supreme council that the Hindraf leaders be set free from their detention under the Internal Security Act.

Samy Vellu however declined to give details. He said he was only trying to help the family of the detained men.

He said their wives were happy and hopeful since he began to work for their release.

“MIC is going all out until we get them released. We are getting help from others to get them out. When they are released, I don’t need anything from them. I’m not doing this for popularity, I’m doing it for the community.”

He also said that MIC won’t pressure the Home Minister or place any conditions. He said he will meet Syed Hamid next week to discuss further.

According to Samy Vellu, the MIC’s effort is in line with its objectives to defend and protect the rights of the Indian community in this country.

“The MIC also wants to pursue this on humanitarian grounds as the families of those involved are suffering and need assistance,” he said.

He added that it was mischevious to suggest the party’s effort was to gain publicity or become popular.

HINDRAF to attend PM Raya open house

So, we can expect few thousand extra visitors to PM open house tomorrow. The open house is at PWTC from 11.30am to 12.30pm for VIP and diplomats, and 12.30pm to 4.30pm for the public.

Hindraf supporters are asked to come in the orange t-shirts to show support. Not sure how many people will be around as its holiday season.

HINDRAF would like to inform the public that the Prime Minister’s department had acknowledged receipt of our request to lead a delegation of 10,000 HINDRAF supporters and that the Prime Minister had been advised accordingly.

HINDRAF call upon all HINDRAF supporters and all Malaysians to visit the Prime Minister on the 1st day open house at PWTC to make it a memorable day whereby each one of us as a citizen of this democratic Malaysia can actually see him eye to eye and wish him a Selamat Hari Raya and demand that the ISA to be abolished and release our leaders along with the others in the spirit of humanity and mankind.

HINDRAF to reimburse the RM1000 fine

PRESS STATEMENT

RE: HINDRAF WOULD UNDERTAKE TO PAY AND REIMBURSE THE RM1000 FINE PAID OR OWED BY ITS SUPPORTERS.

HINDRAF wishes to state that it would reimburse each and every of the 27 supporters who pleaded guilty on 18th September 2008 for the RM1000 they have paid or owe to the court in fine imposed for their participation on the peaceful HINDRAF rally on November 25th last year.

For those who have already paid the fine and those still owing to the court kindly contact our Selangor Coordinator Mr. Selvam on 016 9673066 to help facilitate transfer of funds and fine payment into court.

Forced to plead guilty or not?

The Rm1000 fine each for the 27 accused who pleaded guilty to unlawful assembly during HINDRAF rally has taken a new twist. Waytha claims that the trial of the balance 27 people which will run for two months continuously is an injustice and will cause the accused to lose their jobs:

The movement’s leader in exile P Waytha Moorthy told a press conference in Sentul, Kuala Lumpur via video conferencing, that the 27 individuals would lose their jobs during the two-month hearing.

“This is a great injustice to them. They are bound to lose their jobs, face severe financial crisis and their families would suffer,” said Waytha Moorthy who is in self-imposed exile in England.

The 27 are mostly odd-job workers and labourers who were among 54 individuals jointly charged for participating in an illegal assembly on Nov 11 last year in Kuala Lumpur.

He says that those who pleaded guilty did so out of fear since a prolonged trial period will affect them financially.

Naturally, the lawyer for the accused was incensed after Waytha’s comments. N Sivananthan denied the accusations and condemned Waytha:

In a statement today, their lawyer N Sivananthan denied the allegation and called on all quarters to stop politicising the issue.

He also took a swipe at the London-based Waythamoorthy, saying that he found the latter’s remarks “offensive and ignorant.”

Sivananthan said that the unjust treatment allegation was being equated to the fact that the court had given priority and its time to the trial of the said matter.

“I would like to categorically deny this (the unjust treatment allegation). The offence on which the guilty plea was taken carries a maximum two years’ imprisonment or fine (any amount) or a combination of both.

“Not only did the court only impose a RM1,000 fine, a time period of two months was also allowed for payment of the same with a proviso to extend the period to six months on a case-by-case basis,” he said.

“As a lawyer, I can confidently say that my clients have been treated justly and I find the comments made by Wathyamoorthy (left) from his refuge in London not only offensive but also ignorant.

“The admission of guilt was on the basis that my clients accepted the fact that laws need to be followed and that a failure to disperse when told to do so amounts to a breach of that law,” he added.

Meanwhile, Surendran, the lawyer for Hindraf 5 also chipped in, supporting Waytha:

Hindraf legal advisor N Surendran said that initially, the trial was supposed to last two weeks but was somehow extended to two full months.

Surendran said he has spoken to some of those who had pleaded guilty and claimed that many of them took the plea to avoid being absent from work and be subsequently axed.

“You can see here the enormity of the injustice. We have 27 people who have been forced to plead guilty because of a miscarriage of justice,” he said.

Surendran also urged the attorney-general and the government to drop charges against 27 individuals who he said were exercising their democratic right to assemble peacefully.

This was also rebutted by Sivananthan:

…Sivananthan noted that the comments made by Surendran are rather suspect since none of his clients had indicated that they were being “forced” to plead guilty.

“I don’t think he quite understands the concept of miscarriage of justice. The difference here is that my legal team and I are acting only as lawyers and not politicians whilst the individuals who are making these allegations are trying to dramatise this issue for reasons best known to them.
“I would therefore be grateful if the plea of guilt is not politicised by all parties concerned.”

So, which is which? As a lawyer, would you advise your client to plead guilty to avoid more problems and possible stiffer sentences? As a client, would you expect your lawyer to offer the best advice and as many options as possible to you?

Obviously its strange that this case was given much time and fast-tracked, but it can be taken either way – as a concern for the issue or to pressure the accused.

On the other hand, a sum of RM1000, which can be paid in installments is a good deal for the accused. So, on the smaller, individual scale, the accused can leave all this mess behind and move on in life. On a larger scale, the admission of guilt can be used to further condemn Hindraf, denounce the rally, and to try sway the community back to its original position.

HINDRAF infiltrated?

After Waytha dropped a bomb saying 3 main leaders of HINDRAF are actually conspiring with the police, MIC, and government, the Indian community is having a seizure. The community owes a lot to the HINDRAF awakening, and to find that such news can even see the light of the day speaks bad of the community. Vasantha Kumar, VK Regu, and spiritual advisor Ramaji are accused by Waytha as plotting to break HINDRAF and register it under their names and later be a tool of the authorities. Waytha says that Vasantha is an agent planted by the police, while the other two are conspiring with him (NOTE to myself: Vasantha joined Hindraf last year September).

Their mission is to split Hindraf, then pick up the pieces, re-brand
and re-launch it under their leadership, which would be subservient to
the establishment.

Vasanthakumar is the main man behind the government plot, with Ramaji and Regu as assistants. They have betrayed Hindraf.

Undoubtedly
the trio are collaborating with police intelligence, government
officers and certain political leaders to break up Hindraf and dilute
its struggle.

VK Regu denied the allegations and demanded that Waytha provides proof. Vasantha also denied any links with the police.

Waytha says that he has proof of Regu and Ramaji meeting up with officials from PM’s department and top MIC leaders in the last few months.

Regu has claimed that he was the Hindraf founder secretary and this
was stated in the application submitted on Oct 23 to the Registrar of
Companies when Hindraf was registered as a enterprise. He also
claimed to have accompanied Waythamoorthy to submit the 18-point
memorandum on Hindu rights and interests to the Prime Minister’s Office
in Putrajaya last year. Waythamoorthy confirmed both the claims,
but said Regu was removed from the group immediately after the
application was submitted for “acting against its interests.”

Asked
whether Regu’s expulsion was recorded in the minutes of any Hindraf
meetings, Waythamoorthy’s reply was in the negative, saying: “As an
informal organisation solely managed by him, meetings were never held.”

The revelation by Waytha was sparked by the HINDRAF led prayers organised at the Permatang Pauh by-election time. This prayer caught the eye because:

1. Prime Minister himself dropped by!
2. PM ACCEPTED the 18-point memorandum from the representatives there
3. The prayer was done in a CHINESE TEMPLE!
4. The police PROTECTED the prayer organisers, instead of chasing them away!
5. HINDRAF loyalist who protested againsts the prayers were attacked and some arrested.

Anyway, I doubt that this is the end of the story. More details will be revealed in time to come. I won’t be surprised if MIC has a role in this.
