The Penang Hindu Endowments Board has defended itself against allegations that it has become a political tool of the MIC and Gerakan in Penang and that it is acting beyond its powers.

K Kumaraendran rebutted the claim that political considerations have been the yardstick for the appointment of commissioners and committee- members, who manage the five temples in the state. 

A commissioner and lawyer, he was commenting on a Malaysiakini report last Friday, in which United Hindu Religious Council president G Mugunthan had alleged there is rampant political meddling in the annual appointments.

Under the Hindu Endowment Ordinance, the state governor on the advice of the state executive council appoints a board of commissioners, one of whom must be a government officer.

The board then sets up an endowment management committee consisting of members of public professing the religion applicable to the endowments – in this case, Hinduism.

'Orderly festivals'

According to Mugunthan, political-based appointments of commissioners have become a norm since the 1980s.

Even the board chairperson is a politician, he said, referring to former MIC state chairpersons T Suppiah and K Rajapathy, and current state deputy chairperson PK Subbaiyah.

Over the years many MIC division leaders and prominent Gerakan Indian leaders have been appointed as commissioners. 

Reliable sources had claimed that Penang Chief Minister Dr Koh Tsu Koon (photo ) has insisted on "his men from Gerakan" being appointed.

Kumaraendran also refuted the allegation that the board had overstepped its jurisdiction.
The board is entrusted with managing the temples and their endowments and to organise their religious festivals, he noted.

In this respect, it has a legal obligation to ensure that religious festivals are celebrated in correct and orderly manner.

This involves implementing measures to regulate tanneer panthal (refreshment booths) and installing a centralised system to control the type of music played during Thaipusam each year.

"Various quarters have commended the board for its actions to bring more order into Hindu religious festivals," he added.

Representative of the Indian community in Penang have expressed dismay over their meeting with state chief minister Dr Koh Tsu Koon over the issues affecting the community.Many of them did not believe Koh’s assurance that his Gerakan-led state government will exhaust all means and ways to address and resolve all current issues and problems related to the community in the state.

The meeting between the state government and 40 Indian-based NGOs and temple committees took place last week in a hotel in the island.

Deputy chief minister Abdul Rashid Abdullah, state executive councillors Dr Teng Hock Nan, Dr Toh Kin Woon and PK Subbaiyah, state MIC head Dr K Rajapathy and the state PPP leader Loga Balamohan were part of the state government delegation.

According to Subbaiyah, the meeting was called on by the Koh to get first-hand information from the NGOs on the Indian community grouses and grievances. “The state government wants to work out a policy to help out Penang Indians,” said Subbaiyah. Those who attended the meeting, however, did not believe in the state government promises.

A publicity stunt

Speaking on the condition of anonymity, many leaders questioned the sincerity and honesty of the Gerakan-led state government in safeguarding and enhancing the Indian community’s interests, benefits and rights in Penang.

In 50 years of independence, this is the first time the state chief minister has held a dialogue session with Indian NGOs and temple committees. However only NGOs, temple committees and local community leaders who are presumed as BN supporters were invited to the meeting.

One delegate even questioned if the meeting was a publicity stunt to canvass Indian votes with the election just around the corner.

During the closed door meeting, Koh, who is also the Gerakan president, gave assurance to approximately 120 delegates that his government would carry out all efforts within its powers to upgrade the standard of living of Penang Indians.

Government statistics revealed that Indians made up merely 150,000 of the state’s nearly two million population. However, many local leaders and politicians have frequently questioned the validity of the statistics because they believed the number of Penang Indians were far more than the official figures.

“The BN government tend to downsize the Indian population merely to hoodwink us on the quota system,” alleged a temple leader, who attended the meeting.

A 1998 state-sponsored Social Economic Research Institute (Seri) report on the well-being of Penang Indians revealed that many of them were living in hardship with 70 per cent of them working under the lower income bracket. Seri’s comprehensive report also revealed that majority Indians cannot afford to buy houses, living in heavy debts, and suffering from distress and alcoholism.

No new policy in place

Compared with other ethnic groups, Indians form the highest percentage in school dropouts, suicides and crimes.

Since the report disclosed the frightening truth of the Penang Indians, for the past 10 years local leaders have frequently called on the state government to implement a comprehensive blueprint to upgrade the community. However, until today, the state government has not unveiled any master plan to benefit Penang Indians.

At the meeting, local Indian leaders lamented that Koh did not unveil any policy to prove that the state government was serious in fulfilling its promises. “If Koh and his government was serious, he would have prepared and unveiled an official blueprint by now on the state government present and future efforts and plans to improve the standard of living of the Indian community,” said a delegate.

Although delegates raised various questions touching on housing, temples, Tamil schools and economic opportunities, Koh could not produce any blueprint to allay their fears that majority Penang Indians would continue to live in hardship.

“I can ensure you that the state government will carry out all efforts within its power to address all issues pertaining to Indian affairs,” said Koh. The assurance was not enough to convince the Indian delegates. Unlike the past elections, the Indian mood is different today.

“They are angry when Hindraf made them realise that they had been take for a ride by BN all these years,” said a leading MIC politician.

GERAKAN has asked the Government to take advantage of the higher rubber and palm oil prices to raise estate workers’ wages, Malaysia Nanban reported. It also proposed a special fund to help the children of rubber and oil palm estate workers and former plantation workers. 

Acting Gerakan president Tan Sri Dr Koh Tsu Koon said the move was crucial to help plantation workers, particularly the younger ones in the estates, to earn higher incomes to provide a better life for their families. 

He was speaking to reporters after chairing a four-hour central committee meeting in Kuala Lumpur on Saturday. 

He said he was making the suggestion following a meeting with Indian community leaders in Penang. Party leaders had also met Indian grassroots officials in several places to find ways to improve the community’s socio-economic status. 

On Gerakan, Koh said the party had expanded the Maju Diri programme, a special programme to help the Indian community in Penang, to other states. This programme was initiated eight years ago in the form of sponsoring kindergarten classes, giving financial aid to poor Indian students and paying Tamil schoolteachers’ salaries. Seven Tamil schools in Penang have benefited from the programme so far. 

Koh said Gerakan would also expand the “Lim Keng Yaik Education Fund”, set up by the party adviser, who is also Energy, Water and Communications Minister, to help the Indian community in his Beruas parliamentary constituency. He said the fund, set up three years ago, would be extended to other Gerakan-held state and parliamentary constituencies.

Political meddling in Penang Hindu temples

A Hindu organisation has taken the Penang Hindu Endowments Board to task for acting beyond its jurisdiction and becoming a political tool of the MIC and Gerakan.

The United Hindu Religious Council (UHRC) president S Mugunthan alleged that the board's nine commissioners were appointed yearly based on their political affiliation rather than their knowledge on Hinduism and administrative skills.

He said that the political-based appointment for the board's commissioner position had become a norm since the 1980's.

"It is obvious that the present commissioners were appointed due to their political allegiance with certain parties or leaders notably the MIC and Gerakan,” he said.

Sources close to the endowments board told Malaysiakini that MIC president and Works Minister S Samy Vellu and Gerakan president and Penang Chief Minister Dr Koh Tsu Koon were the most powerful influence behind the appointment of the commissioners.

The source revealed that MIC and Gerakan had been using the commissioners’ position as a political gift to their local leaders.

The present chairman of the endowments board is the state MIC deputy chairperson and executive councillor PK Subbaiyah.

Over the past 20 years or so, many commissioners were appointed from political ranks of MIC and Gerakan.

"This is unwarranted," added Mugunthan.

The statutory powers

Under the Section 3(1) of the Hindu Endowment Ordinance 1906, the state governor on the advice of the state executive council shall appoint a board of commissioners, in which one of whom shall be a government officer.

Under Section 6 of the HEO, the board of commissioners shall appoint an endowment management committee consisting members of public professing the religion applicable to the endowment.

UHRC deputy president K Suppayah, who was appointed as assistant secretary to the commissioner board for more than 20 years (1970-1993), said there was no provision under the ordinance that empowered the board to appoint the management committees to manage any Hindu temples, organise Hindu religious festivals, govern tanneer panthals (refreshment sheds), collect donations and charge devotees with prayer fees of any form.

"The board is only a trustee of Hindu endowments of five temples," he said, while stressing that he had clarified the matter with the Attorney-General Chambers.

At present Hindu endowments belonging to the Waterfall hilltop Sri Balathandayuthabani Kovil , Sri Ramar Kovil in Dhoby Ghaut, Sri Kunj Bihari Krishan Mandir, Lebuh Queen's Sri Maha Mariamman Kovil and Butterworth Sri Maha Mariamman Kovil come under the jurisdiction of the endowments board.

Although it's merely a board of trustees to safeguard and manage the endowments of the five Hindu temples, the statutory body has, however transformed itself into a religious authority to appoint, control and dictate the management committees of the five temples, religious festivals and tanneer panthals (refreshment sheds).

"This clearly contravenes Article 11 of the Federal Constitution which was unambiguous that the government shall not handle religious affairs pertaining to religions other than Islam.

"Since the board is a statutory body, it shall not encroach into Hindu religious affairs," said Suppayah, while adding that the management of the five temples should be left to Hindu public, especially Hindu organisations.

Legal action possible

If the letter of law were to be enforced strictly, the board had no powers to manage temples, interfere in organising of the Thaipusam or Chitra Paruvam festivals and tanneer panthals.

As such, the board would have no authority to stop tanneer panthals from playing their own music during the Thaipusam festival and install a 3km-long single public address system between the Waterfall hilltop temple in Jalan Air Terjun and the Jalan Brown – Jalan Utama.

It also cannot impose charges on devotees for prayers of any form at the five temples.

Technically and ideally, said Suppayah, either existing Hindu organisations shall be allowed or new independent organisations shall be registered to manage each of the temples and organise religious festivals and functions associated with the temples.

"However, the board has now usurped a non-existent power by directly interfering with Hindu religious," he said.

Mugunthan said his council would carry out awareness campaign on the real position and powers of the endowments board since many Hindus were either ignorant and naive about the whole issue.

He did not rule out legal redress on the issue to stop the board from overstepping its judicial boundary thus committing unlawful acts.

"We have to take court action to right the wrong then we will do it," he said.

Malaysia's 'saint of the poor'

Mother Mangalam focused her life on the Pure Life Society after a prayer was answered in 1976.

Datin Paduka Mother Mangalam Iyaswamy Iyer, 81, president of the Pure Life Society, is a relentless social worker bent on serving the less fortunate. This soft-spoken 'mother' to orphans and underprivileged children speaks to SYIDA LIZTA AMIRUL IHSAN about personal struggles, fellow Malaysians and the power of prayer

Q: The Pure Life Society was registered in 1950 to promote multi-religious, multiracial and multi-cultural understanding. Soon after World War 2, it was involved in rescue work and outreach programmes to help the poor. What lessons have you learned along the way?

A: The war was a very big lesson. Everyone had to struggle and start from scratch. I learned a lot from these struggles; to be resourceful, to be able to live with the bare necessities and to learn the feeling of satisfaction.

Those lessons made me what I am. The war displaced families and children. There were people dying from sickness. It made me think hard and got me to do what I do today.

I am, by nature, very much attached to things and people so I cannot handle unexpected deaths. But at this age I have learned to be more steady and stable.

Q: What are some of your personal highlights?

A: If that means something joyful, it was when I came up first in class in Standard Eight (also known as Junior Cambridge). I had worked hard and the results made me happy. The irony was, it happened in 1941, the same year World War 2 broke out in the country.

There have been more struggles than anything else in my life. Sometimes, I get really down. In 1976, for instance, at the time I needed to put up this building badly, my brother was medically boarded in Singapore. I was the eldest in the family and I was responsible for my siblings. So that took a toll on me. On one hand, I had my family and, on the other, the orphans of the society.

I prayed to God and asked that I be shown a way to continue with my work. A couple of weeks later, my mother called to say my dad won first prize in the lottery (so I didn't need to worry about my family). I could literally feel the burden lifting.

It was a change in my pattern of life and I focused on the society.

Q: What are some of the things you have learned about your fellow Malaysians?

A: Malaysians are really a wonderful lot. Somehow, they rise to the occasion every time help is needed. I just have to think about it and it materialises, whatever the needs are. Just the thought will do. Help comes from all races and it's not just in the form of money, but also in service.

Q: Over the years, do you think Malaysians have become more united or less united?

A: In the beginning, this was in the 1940s and 1950s, there were no differences among the people. It was all very inclusive. We didn't regard each other as Chinese, Malay or Indian.

Unfortunately, now, although people try their level best to come together during functions and events, I think it has become a little superficial, and unity is only on the surface. But as far as I am concerned, everyone is my friend.

This society is not a place that's exclusively for Indians. In fact, the first boy from the society to go to university was a Malay.

Before the 1970s, there were Malay kids here. I must say the situation is much better now.

We had three Malay kids here. We sent them to religious classes to learn more about Islam, cooked special food for Hari Raya and made sure they observed their religious practices like fasting.

We should all think that we are part of the human race. If you peel off the skin, we are all the same; same red blood, same bones, same flesh.

Q: What is it about Malaysia that you cannot find anywhere else? What do you love about this country?

A: It is peaceful and that's a fact. Other than war in the 1940s, this country is generally peaceful. Of course, there are bubbles here and there, but that is quite natural. When there is heat inside, there will be bubbles.

But in this country, if you work hard, you will survive and succeed.

Life is much easier now, a far cry from the time of war when I couldn't even find something as simple as aerated water.

And I love Malaysia for the generosity of its people. When (former prime minister) Tun Dr Mahathir Mohamad gave a boost to the Malaysian economy, people had more money to give.

Before that, it was quite difficult to get support. We had to do a lot of fundraising. When the economy got better, people could afford to help more.

Q: Who are your heroes?

A: There are many. Among them are the late Tun Tan Cheng Lock (founder and first president of MCA), the late Pendita Zaaba (educationist and thinker), the late Tun V.T. Sambanthan (former MIC president), the late Datuk Onn Jaafar (Umno founder), the late Tun Mohamed Suffian Hashim (former lord president), and the late Syed Hussein Alatas (founding member of Gerakan).

My heroes also include Raja Muda of Perak Raja Dr Nazrin Shah, Datuk Michael Chong (MCA Public Services and Complaints Department head) and Tan Sri Lee Lam Thye (National Service Training Council chairman).

These people are very broad in their views and understanding. There is an element of wisdom in the way they look at the future.

And I look up to Tun Dr Mahathir Mohamad. He really put Malaysia on the world map.

I also admire Toh Puan Dr Aishah Ong (Universiti Malaya pro-chancellor) and Tun Dr Siti Hasmah Mohd Ali. They stood by their husbands through thick and thin. I admire women who stick by their husbands through difficult times.

Q: You were recently conferred the Datuk Sultan Sharafuddin Idris Shah (DSIS) which carries the title "Datin Paduka" for women by the Sultan of Selangor, Sultan Sharafuddin Idris Shah. How do you feel about that?

A: I feel the same. I'm still the same Mother Mangalam. I hope this will be of help to the organisation though. The praise goes to the children, staff, people around me and the society. Without them I wouldn't be here. And of course, praise be to God.

Q: During the ceremony, the sultan asked you to advise the Indian community not to be extreme. What was your reaction to his request?

A: I believe it is bad for anyone to be an extremist. We must always be moderate in our approach. What the sultan says is correct. If it's extremism that these people pursue, it is not proper.

We already have enough problems in the world, so extremism by anyone, of any race, anywhere, is bad. But whether the people are really extremists is another question altogether, one that I am not in a position to answer.

Q: What do you think about the youth of today? Living in the post-independence era, do you think they have lost sense of the struggle? What do you think they want?

A: Sadly, I think today's youth just want money without having to work hard for it. They always think in terms of money, and they want to study a subject that gives them a lot of money, not what they are passionate about. They change jobs because they want more money. They must realise that money is not everything in life. I think they have become imbued by this sentiment because of the affluent period in the country.

Children demand a lot of pocket money from their parents these days. "Enjoyment" becomes a prominent word in their vocabulary. There is no end to their desires.

They must learn to be satisfied because that is the greatest wealth. Until you are satisfied, you can never be at peace with yourself.

The word "struggle" has no place in the lives of today's youth. They don't want to struggle, they want everything easy. When they go to university, they want loans and scholarships. Even then, some don't repay their loans.

Q: What is your wish for Malaysia as we enter 2008?

A: I hope the mindset of its people will change. I wish adults, from all levels and positions in society and whatever jobs they hold, will become role models to the young.

This is especially so with teachers and social workers because children imitate and follow them.

Q: What do you want to see improved in the country?

A: I think the first thing people must learn is how to maintain their toilets. Public toilets, school toilets, home toilets, anywhere. Once they know how to do that, everything else will follow.

I think the character of a person can be ascertained from how they manage their waste, how they dispose of rubbish, recycle and keep things clean. It's very important.

Q: Could you please share with us what you think is the quintessential Malaysian experience?

A: Food. We get all types of food here. Unfortunately, I'm diabetic so I usually stick to my diabetic bread and raw vegetables wherever I go. But I like food cooked with a lot of spices.

And the friendliness of the people is, I think, something also uniquely Malaysian.
