Kg Buah Pala residents give memo to DPM Muhyiddin

I got to hand it to the residents, they are really pushing every possible button in order to save their land. If state government not able to help, go to Federal. Even though PM Najib already said land matters are state issue, DPM Muhyiddin seem to indicate otherwise.

Not sure what he meant by “The deadline (for the residents to vacate the land) is Aug 31. We want to see how the state government can resolve the issue”. If after 31st August only want to do something, most probably they will only see a flattened land. The developer is itching to demolish the place, so I’m not sure where the DPM is leading the residents to. A false hope? Now the state can turn around and say since the Federal government seem to indicate can do something, we’ll just leave it to them. That’s the peril of jumping ship. Its like burning the bridge at both ends.

I’m sure the residents are aware their problem was caused by the same group from which they are asking for help now. When desperate, have to  resort to desperate measures. Can’t blame them. Now, its up to Federal government to save them. How? Maybe federal government and coalition can make some deal with the coperative and/or the developer, bypassing the state government. Err..along the way, MIC need to be given some role to play as well.

So, its with (in)sincere feeling that the rep, Sugumaran pleads:

“…Now we realise that only the BN can really help the people,” said Sugumaran.

Kg Buah Pala issue may also impact the upcoming by-elections in Permatang Pasir, so each coalition needs to play its card properly. Will this be turned into a racial point? corruption point? administation weakness point? Which coalition can milk the most out of Kg Buah Pala sage to entice the 70% over Malay voters and minority Chinese and Indian voters?

The federal government has so far not intervened in the Kampung Buah Pala land ownership issue as it wants to see whether the Penang government is capable of resolving the issue.

Deputy Prime Minister Muhyiddin Yassin said this to Kampung Buah Pala residents association chairperson M Sugumaran after receiving a memorandum on the issue from him.

“The deadline (for the residents to vacate the land) is Aug 31. We want to see how the state government can resolve the issue,” he said.

The seven-page memorandum was handed to Muhyiddin when he visited Permatang Pasir, near here, to look at the Barisan Nasional’s preparations for the upcoming by-election.

Sugumaran said in the memorandum, the association urged the federal government to intervene in the issue in order to save the traditional village and turn it into a planned village.

He said the residents were forced to ask for federal government intervention following the state government’s failure to keep its promise of helping the villagers if the opposition was given the mandate to govern the state.

“(Lim) Guan Eng (chief minister) cannot assist us. Now we realise that only the BN can really help the people,” said Sugumaran.

The Federal Court recently ordered the residents to vacate the 2.6ha village land belonging to Koperasi Pegawai Kerajaan Pulau Pinang (KPKPP), to make way for a housing project.

However, the Federal Court yesterday fixed Friday to hear a new application by the residents to set aside the Appeals Court’s decision made on May 11, that KPKPP is the rightful owner of the land. – Bernama

Ganabatirau questions Waytha over HiINDRAF and funds

After Waythamoorty gave an interview in Malaysiakini (here and here), one of the HINDRAF 5 ex-ISA detainee raised some questions and allegations, mainly questioning the status of funds collected during the incarceration of the HINDRAF 5. How can they know that collection ran into millions? Bank statements?

Let’s see how Waytha replies. This kind of ding-dong war of words will reveal more and more dirt on either/both sides.  Each will accuse the other, but so far no proof from any quarters. I

Hindraf activist and former ISA detainee V Ganabatirau has accused the outlawed movements current leader, P Waythamoorthy, of using millions of ringgit collected from the people for his personal use while in self-imposed exile in London.

He said funds collected by the movement for the Hindraf 5 who were detained under the ISA, never reached them or their families.

“Initially funds were collected by highlighting the suffering of the so called Hindraf 5. From December 13th 2007, the focus was changed to highlighting the suffering of our family members. The total amount collected runs into millions,” he said when asked to comment on the funds

My family did not receive a single sen from the funds. When questioned, Waythamoorthy,the defacto head, claimed that the funds were meant for a civil suit that was to be filed against the British government.”

But the suit expired as civil matters must be pursed within three months after filing which was Nov 29 2007.

I believe that the suit was deliberately allowed to expire so that he could enjoy his exile and the good life in London.

“All our hopes vanished with Waythamoorthy when he did not pursue the suit.

“The public had high hopes. We only wanted the plight of poor and marginalised Indians here to be exposed. Not for the money,” said Ganabatirau (right).

Wayathamoorthy had last week claimed in an interview with Malaysiakini that the suit was foiled by the Malaysian government and police.

But Ganabatirau rubbished the reasoning given by Waythamoorthy saying that they could ‘never be accepted’.

“Why should he go for a pilgrimage to India on Nov 27 2007?” Ganabatirau asked, recalling the events that led the detention of five of them in Kamunting under the ISA.

According to Ganabatirau, Waythamoorthy personally assured him that the suit would be filed.

Speaking to Malaysiakini, the former lawyer also denied that Waythamoorthy was the movement’s treasurer. [i thought he was the leader, not treasurer]

In fact, Hindraf was registered as an business enterprise and as such, there was no need for a treasurer, he said

Ganabatirau also said the rift in Hindraf began after the suit failed to materialise.

“The started rift during my detention under ISA that led to Uthayakumar to accuse me of being a Special Branch (SB) agent because I raised the suit issue,” he said when asked to comment on allegations that he was a government spy.

Who is the boss?

The Hindraf leader turned activist said that he met Hindraf lawyer P Uthayakumar in December 2006.

Ganabatirau added that he actively organised forums and demonstrations together with (fellow Hindraf activist and former ISA detainee) K Vasanthakumar on temple demolitions between January to April 2007.

Both of us played key roles in pulling in the crowds. Prior to our involvement, the crowds numbered between 20 and 30 people only .”

He added that application for permission for holding the November 25 2007 rally to handover the memorandum to the British government was organised by him and Vsanthakumar.

The suit against the British government intended to claim 1 million pounds sterling for every Indian in Malaysia since independence for displacing them from their homeland.

“Waythamoorthy contributed nothing to the movement except being named plaintiff in the suit. All the trips that he made was paid for by using money collected from the people,” Ganabatirau said when asked to elaborate on the current Hindraf chairperson’s role.

He is a chicken. If there is a forum, he would ask me whether there were police or SB (Special Branch personnel) in the vicinity before coming to give a speech.”

He also commented on RS Thanenthirran’s involvement in the movement.

“Why was there no condemnation from Waythamoorthy against Thanentirran who ‘hijacked’ the term ‘Makkal Sakthi for the party. Both Vasantha and I coined the term.”

RS Thanentiran formed Malaysia Makkal Sakthi Party which made overtures to the BN government that led to the possibility of Waythamoorthy’s anticipated return to Malaysia.

‘Hijacked movement’

“Waythamoorthy also appointed himself as the chairman of Hindraf and appointed Thanenthirran and S Jayathas as coordinator. Who made him the boss? There was no election. Who gave him the right to appoint and dismiss coordinators?

Ganabatirau also added that he was also against the idea of Hindraf activists visiting the then Prime Minister Abdullah Ahmad Badawi as it was Thanenthirran’s method of hijacking Hindraf.

“Don’t you see that he is discriminating and marginalising me and Vasanthakumar even as he speaks on the discrimination and marginalisation of the Indian community ever since we were detained?

Ganabatirau also questioned the motives of Waythamoorthy who is blaming Pakatan Rakyat for the Kampung Buah Pala fiasco.

“Whom does he want to please to ensure his safe return?”

Ganabatirau, along with K Vasanthakumar, K Kenghadaran, P Uthayakumar and M Manoharan, were key leaders who led 30,000 people in a protest rally against the marginalisation of the Indian community in Malaysia in Nov 2007.

The large scale demonstration in Kuala Lumpur led to the detention of the five under Internal Security Act.

Kg Buah Pala can unite Indians?

Unlike other races in the country, very few things can unite the Indian community. One such event that came close to achieving some resemblance of unity in recent years was the Hindraf rally in 2007. There’s another indicator as well – MIC’s membership which  claim to be in the region of half a million or so.

Other than the above two, I fail to see any other items/ideals that Indians agree upon. Be it religion, language, tamil schools, Thaipusam holiday, political parties, 1Malaysia, lockup deaths, temple relocation, etc. Every faction has its own opinions, often contradictory.

Could it be that for once, regardless its right or wrong, all Indians stand behind the residents of Kg Buah Pala (one of the current hot issues affecting the community)? Would it cause a ripple or change anything? Can we see political party representatives stand together in front of the bulldozers, instead of some leaders conveniently switching of their handphones (as was claimed in some articles)? We can learn from our brothers from the other community – one death related to MACC, and the community is showing anger. Or mention Islam, and the Muslims join  hands faster than a speeding bullet (being dramatic here).

Its clear the political parties are not really supporting the residents but merely playing dramatic scenes, while the media is portraying the residents as being “greedy”. PM Najib washed his hands off the problem, saying land is state issue. Ex-CM virtually dissappeared from the face of the earth, current CM talking law too much. Champion of community says got up to RM5 million to help state buy back land.

Kg Buah Pala is a straightforward issue. Any right thinking Malaysian will consider the rule of law, and also the “compassionate”  and “natural justice” part. If need to, suspend the development order until all investigations are initiated and completed. But where is MACC and other law enforcement agencies?

There are some valid questions asked by people – why no action taken to formalise or verify the land ownership for past 50 years? Why no advice to the residents? Why sell cheap? Why sell to that company? Why new government accept final payment? Can the agreement/sale be undone or halted? How can  try to demolish when there’s a review pending on 18th August?

I’m sure many smart and learned Malaysians can ask more questions, but who is actually answering these questions? Is it the stakeholders like residents, ex-CM Koh Tsu Koon, federal government, state government, cooperative, developer, the politicians who made promises, the champion of the community reps who didn’t do the job? How reliable are these answers?

If the issue of Kg Buah Pala happened to you – someone comes along and says that your ancestral house is no more yours because it was under the care of the government all this time and was sold it to a third person –  what would you do? Some may say tough luck and move on, others will fight to the end. If you feel you are on the side of justice, surely you’ll feel aggrived. If you felt that its your fault that never verify or follow up with the land matters, you will move on.

So, at the moment, its hinging on the 18th court hearing. After that, this issue will be forgotten, probably until next general elections. Well, one good lesson from this – please check the ownership of the land you occupy (make it an annual affair, just like paying tax or renewing car license). Remember that what happened to Kg Buah Pala residents can happen to you too.

No place for temple in Shah Alam?

This is an interesting news: The original location had 99% Muslims, so shift the temple (so says the article). Proposed location in Section 23 has 70% Muslims, so the residents have created a committee to protest. Since Shah Alam was created in the late 1970s as a”planned city”, the aim was to populate it with certain race, thus the situation we see now. Acres of estates was redeveloped and the Indians dissappeared. The whole of Shah Alam has become overwhelmingly majority Muslims. I had lots of problem looking for proper Indian restaurant when staying there. Had to travel to either Klang or Sri Muda from Section 17. After a while, one opened at Padang Jawa, so still OK.

Going by population ratio, looks like have to shift the temple to Sri Muda (which is fast becoming a foreigner-majority area) or out of Shah Alam.  Unless the parameter used is different. For example, one temple for every 10km or for every place with 100 Hindu families. As the saying goes, “don’t stay in a place that doesn’t have a temple”.

Having said all that, maybe there’s too many temple in that area, and they can combine two or more into one bigger complex?

The Section 23 site on industrial land near Taman Ixora was picked for the Sri Mariamman temple as there was no other vacant site that was suitable.

The chairman of the Selangor state committee for welfare, women’s affairs, science, technology and innovation, Rodziah Ismail, said this was also because the industrial site of 0.2 hectares in Section 23 had been converted to place of worship status.

However, she said, since there had been objections from the residents, the issue will be referred to higher authorities for further action. She said this to reporters after the Programme with Kuwait Finance House and the handing over of Si Manja TAWAS (Tabung Warisan Anak Selangor) cards at Section 7 here today.

Rodziah, who is Batu Tiga state assemblyman, was asked to comment on the objections of Taman Ixora residents who did want the temple near their houses.

She said she and the Shah Alam member of parliament, Khalid Abdul Samad, the Selangor State Development Board and Shah Alam City Council will meet with the residents.

Yesterday, the Section 23 action committee against the temple construction sent a protest memorandum to Rodziah saying the temple was just 160m from houses, 50m from a playground and 150m from Surau Al-Jannah at the housing estate.

The committee also asked why there was no public hearing on the matter and that 70 per cent of the residents there were Muslims.

Rodziah said a public hearing was not necessary as the area was industrial land.

She said the temple was being moved from Section 19 as the area was 99 per cent Muslim and was near a residential area. — BERNAMA

Demolition at Kg Buah Pala today

Its a tense situation at Kg Buah Pala today, as the developer arrived with loads of workers and few bulldozers to demolish the houses there. The residents, with activitists, NGOs etc are putting up a stand, not willing to give way. FRU and police trying to maintain the situation. Developer says demolition will go on today. It seems three houses are targetted.  Villagers claim will be contempt of court since appeal hearing is on August 15 or 18.
